Terms of Service

These Terms of Service ("Terms") set out the conditions for using chat.garando.dev (the "Service"), operated by its operator ("we/us"). By using the Service you are deemed to have agreed to all of these Terms.
Article 1 (Nature of the Service)
The Service provides a "place" for anonymous, no-registration text chat using WebRTC peer-to-peer (P2P) connections.
- Chat messages and reactions are encrypted on the user's device and exchanged directly between users' devices; they are not stored on our servers.
- Our server only brokers the WebRTC handshake (signaling), counts the participants currently connected, and — for user pairs that cannot establish a direct connection — forwards data that remains encrypted. The encryption key is never sent to our server, so we cannot decrypt or read the forwarded data.
- The Service is intended for small, private use; each room has a participant limit.
- No chat history is kept. Content sent before you joined a room cannot be retrieved afterwards.
Article 2 (Free of Charge; No Warranty)
The Service is provided free of charge and "AS IS". We make no warranty, express or implied, as to completeness, accuracy, usefulness, fitness for a particular purpose, continuity, or freedom from errors or interruptions. We may change, suspend, or terminate all or part of the Service without prior notice.
Article 3 (User Responsibility and Content)
Users bear full responsibility for all information they transmit or display through the Service ("User Content"). We are technically unable to view, monitor, or store User Content exchanged in encrypted form, and assume no obligation to monitor it. Disputes between users shall be resolved at the parties' own responsibility and expense.
Article 4 (Prohibited Conduct)
Users must not engage in any of the following:
- Acts that violate laws, regulations, or public order and morals
- Infringement of third parties' copyrights, trademarks, portrait rights, privacy, honor, or other rights or interests
- Transmission of content constituting sexual exploitation or abuse of children (including child sexual abuse material) or other illegal or harmful content
- Transmission of obscene, violent, or discriminatory content; harassment, bullying, or threats
- Impersonation of others or spreading false information
- Unauthorized access to, excessive load on, or analysis/disruption of the Service or its infrastructure
- Using the Service for, or facilitating, criminal activity
- Any other act we reasonably deem inappropriate
Article 5 (Age Restrictions)
The Service is not intended for persons under 13 (or under a higher age if required by the laws of the user's country or region). Minors should use the Service with the consent of a parent or legal guardian.
Article 6 (Note on P2P Communication)
Because the Service uses P2P connections, your public IP address may be visible to other participants connected to the same room. This is an unavoidable characteristic of P2P communication and is beyond our control. Users accept this in using the Service.
Article 7 (Managing Invite Links)
The invite link (URL) of a room you create contains that room's encryption key. Anyone who knows the invite link can join the room and read the ongoing conversation. Users manage and share invite links at their own responsibility; we are not liable for damage arising from leaked links.
Article 8 (Third-Party Services)
The Service relies on third-party services including Cloudflare (hosting infrastructure), Google Fonts (font delivery), Google Analytics (usage analytics), and Google Forms (contact). Use of these services is governed by each provider's terms and privacy policy. We are not liable for damage caused by third-party services.
Article 9 (Intellectual Property)
Intellectual property rights in the software, source code, design, logos, and text constituting the Service belong to us or their rightful owners. Users may not reproduce, modify, repurpose, or distribute them without our permission.
Article 10 (Disclaimer; Limitation of Liability)
To the maximum extent permitted by law, we are not liable for any damage arising from use of or inability to use the Service, interactions between users, User Content, third-party services, or otherwise in connection with the Service.
Where mandatory law (such as consumer-protection legislation) applies and the above disclaimer is not permitted, we shall be liable only to the extent permitted by such law; absent willful misconduct or gross negligence on our part, liability is limited to ordinary and direct damage actually incurred. As the Service is provided free of charge, our aggregate liability shall in no event exceed JPY 1,000.
Article 11 (Indemnification)
If a user violates these Terms or causes a dispute with a third party in connection with the Service, and we incur damage (including reasonable attorneys' fees) as a result, the user shall compensate us for that damage.
Article 12 (Suspension or Refusal of Use)
We may restrict or refuse a user's use of the Service without prior notice if the user violates these Terms or if we reasonably deem it necessary.
Article 13 (Changes to These Terms)
We may amend these Terms as necessary. Amended Terms take effect when posted on this page. Continued use of the Service after an amendment constitutes acceptance of the amended Terms.
Article 14 (Governing Law and Jurisdiction)
These Terms and use of the Service are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction in the first instance over disputes arising between us and users in connection with the Service.
